Privacy Policy
This policy explains what personal information we collect about you, why we collect it, what we do with it, and how you can access it, correct it or complain about how we have handled it.
1. Who we are
Free Land Division is a trading brand of Curated Property Group Pty Ltd (ABN 87 678 826 429) ("we", "us", "our"). We partner with landowners in South Australia to fund and manage land divisions.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We have chosen to comply with the APPs and to be bound by this policy regardless of whether the small business exemption would otherwise apply to us.
2. What information we collect
The personal information we collect depends on how you interact with us.
When you submit an enquiry
- Your full name
- Your email address
- Your phone number
- The address of the property you would like assessed
- Any other information you choose to include in your message
- A record of the consents you gave, including the date and time and the wording shown to you
If we proceed to assess a property or enter an arrangement with you
- Property details — title particulars, land size, zoning, easements and existing structures
- Information from public registers, including title searches and planning records
- Correspondence between us
- Where required for a transaction, identity verification information and banking details for settlement
When you visit this website
- Your IP address, browser type and device information
- Pages you viewed and the time of your visit
- Analytics information, but only if you have consented — see section 10
We do not collect sensitive information (such as health information, racial or ethnic origin, or political opinions) and we ask that you do not send it to us.
3. How we collect it
Wherever it is reasonable and practicable, we collect personal information directly from you — through our enquiry form, by phone, by email, or in person.
We may also collect information about a property from public sources such as the Land Services SA title register, PlanSA planning records, and council records. This may include information about you as the registered proprietor.
If someone else refers you to us, we may receive your contact details from them. If that happens, we will tell you where we got your details when we first contact you.
4. Why we collect it and how we use it
We collect and use your personal information to:
- Respond to your enquiry
- Assess whether your property is capable of being divided and whether a division is financially viable
- Prepare and discuss a proposal with you
- Enter into and perform an agreement with you, if we both decide to proceed
- Engage the surveyors, planners, consultants and conveyancers needed to carry out a project
- Send you marketing communications, but only where you have separately consented — see section 5
- Meet our legal, accounting and record-keeping obligations
If you do not provide the information we ask for, we will not be able to assess your property or respond to your enquiry. The name, email, phone number and property address on our enquiry form are all necessary for this purpose.
We will not use your personal information for a purpose unrelated to those above unless you would reasonably expect it, you have consented, or we are required or authorised by law to do so.
5. Direct marketing, email and SMS
We will only send you marketing emails or SMS messages if you have given us express consent to do so. On our enquiry form that consent has its own tick box, which is optional and starts unticked. It is separate from the required box, which covers only contacting you about your enquiry and your acknowledgement of our Full Disclosure, Terms & Conditions and Privacy Policy.
Leaving the marketing box unticked does not affect your enquiry in any way, and we will not treat an enquiry on its own as consent to market to you. We record what you agreed to and when, so we can show that any consent we rely on was voluntary, informed, specific and current.
Every marketing message we send will:
- Clearly identify Curated Property Group Pty Ltd as the sender and include our contact details
- Contain a functional and free unsubscribe mechanism
To opt out at any time:
- SMS — reply STOP to any message
- Email — use the unsubscribe link at the bottom of any email
- Either — email info@freelanddivision.com.au and ask us to stop
We will action any opt-out request within five business days, as required by the Spam Act 2003 (Cth).
Separately, if you submit an enquiry we may contact you by phone about that enquiry. If you tell us you do not wish to receive calls, we will stop.
6. Who we share it with
We do not sell your personal information, and we do not trade in it.
We may disclose your personal information to:
- Professional service providers engaged on your project — licensed surveyors, town planners, civil engineers, conveyancers, lawyers and accountants
- Service authorities and government bodies — your local council, PlanSA, the State Commission Assessment Panel, SA Water, SA Power Networks and Land Services SA, where required to progress an application
- Licensed real estate agents, where a property or allotment is to be marketed
- Our IT and business service providers — including website hosting, email, and the systems we use to record enquiries
- Anyone else you have authorised us to share it with
- A regulator, court or other person, where we are required or authorised to do so by law
7. Overseas disclosure
Some of the technology providers we use to run this website and store enquiry records may hold data on servers outside Australia, including in the United States. This applies to our website hosting provider and, where applicable, the systems that receive enquiry form submissions.
Where we disclose your personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
Note for review: this section must be confirmed against the final choice of website host and enquiry form provider before this policy is published, and the list of countries updated to match.
8. How we store and protect it
We hold personal information in electronic form in the business systems we use to run our business. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to the people who need it, using reputable providers, and using accounts protected by strong authentication.
No method of transmission over the internet is completely secure. While we take reasonable steps to protect your information, we cannot guarantee its absolute security.
If we become aware of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.
9. How long we keep it
We keep your personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law.
- Enquiries that do not proceed — generally retained for up to two years, then destroyed or de-identified
- Projects and agreements — retained for at least seven years after the arrangement ends, to meet taxation and record-keeping obligations
- Marketing consent records — retained while consent is current and for a period afterwards, so we can demonstrate that consent was properly obtained
10. Cookies and website analytics
This website uses a small number of cookies. Cookies that are strictly necessary for the site to function are always used. Analytics cookies are used only if you have given consent through the banner shown when you first visit.
You can change or withdraw your choice at any time on our Cookies Policy page, which sets out exactly what each cookie does.
11. Accessing and correcting your information
You have the right to ask for access to the personal information we hold about you, and to ask us to correct it if it is wrong.
To make a request, email info@freelanddivision.com.au or call 0452 249 400. We may need to verify your identity before we can act on your request.
We will respond within a reasonable period, and normally within 30 days. We do not charge a fee for making a request. If we refuse a request, we will tell you in writing why we refused it and how you can complain about that decision.
12. Complaints
If you think we have mishandled your personal information or breached the Australian Privacy Principles, please tell us first so we can try to put it right.
Send your complaint to info@freelanddivision.com.au marked "Privacy complaint", with enough detail for us to understand what happened. We will acknowledge your complaint within five business days and aim to resolve it within 30 days.

13. Changes to this policy
We may update this policy from time to time. The current version is always available at this address, and the "last updated" date at the top shows when it last changed. If we make a significant change to how we handle personal information, we will take reasonable steps to tell you.
